Myti Referral Program Terms

These “Program Terms” govern participation in Myti’s Referral Program — the way Vermont businesses, customers, and community members invite new shops to join the Myti Commons (Myti’s network of Vermont businesses). The Referral Program is run by Sustain Local LLC (DBA Myti), 1357 Texas Hill Road, Hinesburg, VT 05461.
1. What the Referral Program is
Myti’s “Referral Program” lets registered participants (“Referrers”) invite Vermont businesses (“Referees”) to join Myti and earn promotional referral rewards when Referees reach the qualification milestones described below. Both Referrer and Referee may earn up to $50 per qualifying referral, paid in two stages.
The Referral Program is intended solely to reward direct introductions of legitimate Vermont businesses to Myti and is not a multi-level marketing, franchise, business opportunity, sales representative, or broker program.
2. Acceptance of these Program Terms
The Referral Program is governed by these Program Terms, which, together with the most current versions of Myti’s Privacy Policy, Myti’s Shopkeeper Agreement (if you are a Shopkeeper), and Myti’s Terms of Use (if you are a customer or other Marketplace user), form the entire agreement between you and Myti regarding the Referral Program.
By opting into the Referral Program, clicking to accept these Program Terms, using a referral code, submitting a referral, or accepting a referral reward, you agree to be bound by these Program Terms. If you do not agree to these Program Terms, you may not participate in the Referral Program.
3. Who can be a Referrer
You can be a Referrer if you are:
- 18 years of age or older
- A U.S. resident, with a valid mailing address and Tax ID (SSN or EIN) available on request
- One of:
- An existing Myti shopkeeper with an active vendor account at commons.myti.com
- An existing Myti.com customer with an active customer account
- A community member who registers as a Referrer through Myti
You may not be a Referrer if you are a Myti employee or contractor, or if your Myti account has been suspended or removed for violating a Myti agreement.
Referral rewards are conditioned on the Referee independently satisfying Myti’s onboarding and participation requirements. Myti reserves the right to approve or reject any applicant in its discretion.
4. How to become a Referrer
You become a Referrer by opting into the Referral Program through your Myti account or by registering at Myti’s public Referrer signup page. On opt-in, Myti will assign you a unique referral code that you can share to invite Vermont businesses.
You may have only one referral code at a time per account. If you have multiple Myti accounts (for example, a shopkeeper account and a customer account), each account has its own code.
You may not use unsolicited commercial email, automated messaging, deceptive advertising, coupon aggregation services, or other unlawful or abusive practices to promote referral codes or the Referral Program.
Referrers are responsible for complying with applicable advertising and disclosure laws when promoting Myti or the Referral Program.
5. How a referral is attributed
To attribute a referral to you, the new shop must enter your referral code at the time they apply to Myti, or at any later time before the first qualification milestone is reached (as described below). Once that milestone is reached, attribution is locked.
If the shop applies without entering any code, they are offered the option to direct the Referrer reward to one of five Myti partner charities (501(c)(3) organizations Myti selects and rotates periodically). If the shop selects a charity, that selection is locked at the same point.
A given shop can be referred only once. The Referrer of record is the person whose code the shop self-attested. Myti does not arbitrate disputes between people who claim to have referred the same shop.
Myti reserves the right to determine final referral attribution in cases involving technical error, suspected fraud, abuse of the Referral Program, or other unusual circumstances.
6. Qualification milestones and rewards
A referral earns rewards in two stages, each tied to a specific milestone:
Milestone 1 — Items live ($25 to Referrer, $25 to Referee). The Referee successfully lists at least one product on Myti.com.
Milestone 2 — First delivered sale ($25 to Referrer, $25 to Referee). The Referee receives a customer order through Myti.com that is fulfilled, delivered, and not refunded within 14 days of delivery. The 14-day hold exists so that rewards reflect genuine completed sales. If the qualifying order is refunded during the hold, the milestone is not met for that order; the milestone remains pending until another qualifying order is delivered (subject to the deadline set forth below).
7. Deadline
A referral expires unpaid 12 months after the Referee’s application is approved if both milestones have not been reached by that date. Any rewards already earned before expiration are unaffected.
8. How rewards are paid
The reward form depends on the recipient:
- Myti shopkeepers receive cash via ACH, paid through Myti’s regular bi-weekly payout cycle. Shops must have a verified bank account on file with Myti’s payment processor.
- Customers and community Referrers receive a $50 Myti gift card, valid on purchases at Myti.com. Gift cards do not expire.
- Partner charities (in the case of orphan referrals where no Referrer code was entered) receive donations on a quarterly schedule, with annual donation acknowledgment letters.
Referral rewards are non-transferable and may not be exchanged for cash.
9. Tax responsibility
Referral rewards, including cash rewards and gift cards, may be taxable income. To the extent required by applicable law, Myti will issue IRS Form 1099-NEC or other appropriate tax reporting documentation to Referrers who meet applicable reporting thresholds (currently $2,000 or more in a single calendar year). When a Referrer’s cumulative earnings reach $1,500 in a calendar year, Myti will request a Form W-9; payouts will pause until the W-9 is received.
You are responsible for any tax obligations arising from your participation. Myti is not providing tax advice.
10. Single-hop, no multi-level
This is a single-hop program. You earn rewards only for shops you directly refer. There are no chains, no downstream payments, and no recruitment trees. If a shop you referred later refers another shop, you do not earn anything from that downstream activity.
11. Disqualification
Myti reserves the right to refuse, void, or (where rewards have not yet been paid) decline to pay rewards if:
- The Referrer and the Referee are the same person, household, or business entity
- The referral involves fabricated activity, false identities, or other fraud
- The Referee was already in Myti’s onboarding pipeline through direct outreach by Myti before the referral attribution
- The Referee is removed from Myti for violating any Myti agreement
- Any party involved in the referral transaction materially violates these terms
Myti reserves the right to review and investigate referral activity and may delay or withhold payouts during investigation of suspected fraud, abuse, or violations of these terms.
Except where required by law or in cases of intentional fraud, once a reward has been paid (cash, gift card, or charity donation), Myti will not claw it back. Pattern-based concerns that surface after payout may result in the Referrer being removed from the Referral Program prospectively.
12. Privacy
When a shop attributes their application to your referral code, your name and existence as a Referrer will be visible to that shop. As a Referrer, you will be able to see the status of the referrals attributed to you (the Referee shop’s name, the milestones reached, the reward amounts earned and pending). Referrers are not entitled to access confidential business, sales, customer, or operational information of Referees. Myti’s general Privacy Policy applies in all other respects.
13. Electronic communications and Referral Program records
Myti may maintain records of participation, acceptance, referrals, referral-code usage, communications, rewards activity, timestamps, IP addresses, and related Referral Program activity for purposes of administering the Referral Program, preventing fraud, resolving disputes, and verifying compliance with these Program Terms.
You consent to the use of electronic records and electronic communications relating to the Referral Program and acknowledge that you have the ability to access and retain a copy of these Program Terms.
14. Right to modify, terminate, interpret the Referral Program
Myti may modify or terminate the Referral Program at any time, with reasonable notice posted on this page or sent by email to active Referrers. Rewards already earned in accordance with these terms at the time of modification or termination will be paid out.
Myti may also modify these Program Terms. Material changes will be communicated to active Referrers and will take effect 30 days after notice. Continued participation in the Referral Program after the effective date of updated Program Terms constitutes acceptance of those changes.
Myti reserves the right to interpret and apply these Program Terms and to make final decisions regarding eligibility, attribution, qualification milestones, and rewards.
15. Disclaimer of warranties
The Referral Program is provided on an “AS IS” and “AS AVAILABLE” basis. Myti makes no representations or warranties regarding the availability, operation, or continuity of the Referral Program, or that any referral will result in a qualifying shop or reward. To the fullest extent permitted by law, Myti disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
16. Limitation of liability
To the fullest extent permitted by law, Myti will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Referral Program. Myti’s total liability relating to the Referral Program will not exceed the total rewards paid or payable to you under the Referral Program.
17. Your responsibility for third-party claims
You are responsible for claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- your participation in the Referral Program;
- any false, misleading, unlawful, or inaccurate statements you make about Myti or the Referral Program;
- misuse of referral codes or the Referral Program;
- disputes between you and any Referrer, Referee, Shopkeeper, Customer, or other third party; or
- your violation of these Program Terms or applicable law.
You agree to reimburse and protect Myti and its officers, employees, agents, and affiliates from those claims, losses, damages, liabilities, and expenses.
18. Your relationship to Myti
Participation in the Referral Program does not create any employment, agency, partnership, franchise, joint venture, independent contractor, broker, or sales representative relationship between you and Myti.
19. Governing law
These terms are governed by the laws of the State of Vermont, without regard to its or any other state’s conflict-of-law principles. Any dispute arising from or related to the Referral Program will be brought in a court of competent jurisdiction in Vermont.
20. Severability
If part of these terms is found to be invalid or unenforceable under applicable law, the rest of the terms will still remain in effect. If a provision cannot be enforced in one jurisdiction, that does not affect its enforceability in any other jurisdiction to the extent permitted by law.
21. Notices
Myti may provide notices relating to the Referral Program by email, through the Myti platform, or by posting updates to these Program Terms or other program materials.
22. Entire agreement
The most current versions of Myti’s Privacy Policy, Myti’s Shopkeeper Agreement (if you are a Shopkeeper), and Myti’s Terms of Use (if you are a customer or other Marketplace user), are expressly incorporated by reference and, together with these Referral Program Terms, constitute the entire agreement between you and Myti regarding the Referral Program.
